Pre-Nuptial Agreements
8th August 2024
Should I enter into a pre-nuptial agreement?
A pre-nuptial agreement is an agreement that you enter before a marriage to regulate what happens to your finances if the marriage does not work out.
Although not absolutely binding, the court will seek to apply a prenuptial agreement unless it is unfair.
An agreement can be seen as unfair by considering the circumstances that it was entered, such as whether someone was under undue pressure, whether one or either party had not declared all their assets or the agreement failed to meet even the basic needs of a party.
In reality, the agreement can have a huge impact on a final settlement in divorce.
If you are planning to get married and you want to protect your financial position if the marriage does unfortunately end in divorce then a pre-nuptial agreement is a good way of planning for all eventualities of life.
It is advisable to obtain good legal advice if you are considering a pre-nuptial agreement to ensure that it is drawn up correctly and all issues have been fully considered. To consult one of our expert lawyers in Bradford or Keighley contact us on 01274 305380
